Cassie Cares provides estate sale management, online auction services, consignment services, organizing/downsizing assistance, and item valuation. Specific services are governed by a separate Service Agreement or Consignment Agreement provided at the time of engagement.

3. USER ACCOUNTS & ONLINE TERMINATION

3.1 Account Creation: You agree to provide accurate and current information. You are responsible for maintaining the confidentiality of your credentials.

3.2 Account Security: Notify us immediately of any unauthorized access.

3.3 The Right to Terminate: In compliance with modern consumer protection standards, if you have created an account on our Website, you may terminate or delete your account at any time through your account settings or by contacting Info@CassieCaresLLC.com. We will process deletion requests within a reasonable timeframe, subject to data retention required for tax or legal purposes.

4. USER CONDUCT & ANTI-SCRAPING

By using our Website, you agree not to:

  • Use any robot, spider, crawler, or automated means to "scrape" or harvest item descriptions, photos, or pricing data for use on third-party auction aggregators without our express written consent.

  • Use the Services for any illegal purpose or to infringe upon the intellectual property of others.

  • Post defamatory, inaccurate, or objectionable content in reviews or community areas.

5. CONSIGNMENT AND ESTATE SALE TERMS

  • Agreements: All physical estate sales and consignments require a signed, separate written agreement governing commissions and fees.

  • Warranties: You represent that you have full legal title to all items provided to us and that items are free from liens, encumbrances, or illegal status (e.g., prohibited ivory or counterfeit goods).

6. INTELLECTUAL PROPERTY & AI CONTENT

6.1 Our Property: All text, photos of estate items, and logos are the property of Cassie Cares.

6.2 AI Disclosure: We may occasionally use AI tools for photo enhancement or to assist in drafting market descriptions for items. We do not permit users to use our content to train machine learning models without a specific commercial license from us.

6.3 User Content: If you submit reviews or photos, you grant us a perpetual, royalty-free license to use that content for marketing purposes.

7. PAYMENT & REFUNDS

  • Service Fees: Fees are outlined in your specific Service Agreement.

  • Online Store Purchases: Items sold through our online store or eBay are subject to the specific return/refund policies listed on those platforms. Generally, estate sale items are sold "As-Is, Where-Is" with no warranties unless otherwise stated.

8. DISCLAIMERS & LIMITATION OF LIABILITY

8.1 "As-Is" Basis: The Website is provided without warranties of any kind. We do not guarantee that item descriptions are 100% error-free, as we rely on information provided by consignors and historical research.

8.2 Liability Cap: To the maximum extent permitted by law, Cassie Cares’ total liability for any claim shall not exceed the amount paid by you to us during the twelve (12) months prior to the claim.

9. DISPUTE RESOLUTION

9.1 Governing Law: These Terms are governed by the laws of the State of Colorado.

9.2 Arbitration: Any dispute shall be settled by binding arbitration in Denver, Colorado, administered by the American Arbitration Association.

9.3 Class Action Waiver: You agree to resolve disputes only on an individual basis and waive the right to participate in a class-action lawsuit.

10. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Website signifies your acceptance of the updated Terms.
